What couples should know about the Special Marriage Act
For a marriage intended to be solemnized under the Special Marriage Act, Section 5 requires written notice to the Marriage Officer of a district where at least one party has resided for not less than thirty days immediately before the notice.
The Act provides for publication of the notice and a thirty-day period during which objections may be made on statutory grounds. Before solemnization, the parties and three witnesses sign a declaration in the presence of the Marriage Officer; after solemnization, the marriage certificate is signed by the parties and the three witnesses.
These provisions are different from simply registering a marriage already solemnized under another applicable law, so couples should identify the correct route before planning dates and witnesses.
Registration of a marriage celebrated in another form under the Special Marriage Act
Chapter III of the Special Marriage Act contains a separate procedure for registration of certain marriages celebrated in other forms. Section 15 sets statutory conditions, and Section 16 provides for public notice, a thirty-day objection period, and a certificate signed by the parties and three witnesses if the conditions are satisfied.
